Introduction and Purpose

By accessing our website, the user and/or purchaser agrees to be bound by these Terms and Conditions for the use of the shopping platform (“the Platform,” “the Website,” or “the Site”), together with all other policies, terms, and documents referenced herein (collectively, the “Conditions”), regardless of the application, digital medium, support, or device used to access it.

Please read these Terms and Conditions and our Privacy and Cookies Policy carefully before placing an order. By using this website or placing an order through it, you agree to be bound by these Conditions and our Privacy and Cookies Policy and to comply with all applicable laws and regulations of the Republic of Colombia. If you do not agree with all of the Terms and Conditions and the Privacy and Cookies Policy, you should refrain from using this website.

These Terms and Conditions and Privacy Policies may be modified at any time without prior notice at the sole discretion of OUZZO S.A.S., identified with Tax ID (NIT) 901.682.401-4, hereinafter referred to as “OUZZO S.A.S.”, owner of the trademark “OUZZO” registered before the Colombian Superintendence of Industry and Commerce. Any modifications shall become effective immediately upon publication.

Acceptance of Terms and Conditions

By checking the box labeled “I Accept the Terms and Conditions” or otherwise accepting these Conditions, you expressly acknowledge and agree, on your own behalf, on behalf of your employer, or as the legal representative of a legal entity, that you are entering into a legally binding agreement with OUZZO S.A.S.

In accordance with Article 52 of Colombian Law 1480 of 2011, you represent that you are at least eighteen (18) years of age, or if acting on behalf of a legal entity, that you have the authority to legally bind such entity. By accepting these Conditions, you acquire the status of User (“User” or “Users”).

You warrant that all information provided in connection with your registration or order is accurate, truthful, and complete. OUZZO S.A.S. is under no obligation to accept any order and reserves the right to verify or reject any order at its sole discretion without providing reasons.

The Platform provides a service through which Users may purchase goods and products (“Products”) directly offered by OUZZO S.A.S. under the OUZZO brand.

The User’s sole contractual relationship is with OUZZO S.A.S. for the purchase and sale of Products through the Platform. At no time is a purchase agreement entered into directly with the manufacturer or trademark owner of the Products.

Registration and User Classification

To become a User, individuals or legal entities wishing to purchase Products through the Platform must provide the required registration information, which will be validated by OUZZO S.A.S.

If errors are identified during the validation process, the User will be notified by email and asked to correct the information. Once corrected, the User account will be activated. If no errors are found, the account will be activated immediately.

Upon acceptance of these Conditions and successful validation, the Platform will create a user account and provide login credentials. The User is solely responsible for safeguarding their password. Any activity carried out using the User’s credentials shall be considered valid and binding upon the User.

To place an order, the User must:

  • Be a consumer and not a distributor.

  • Be at least 18 years of age.

  • Have a valid credit or debit card.

  • Have a physical delivery address within Colombia.

The sales contract shall only be deemed concluded once OUZZO S.A.S. confirms the order via email. Any order submitted by the User constitutes merely an offer to purchase.

OUZZO S.A.S. reserves the right to verify inventory availability and compliance with its sales conditions and may reject any order without explanation.

User Obligations

In addition to any other obligations contained herein, the User agrees to:

  • Pay for Products in a timely manner.

  • Provide accurate and up-to-date information.

  • Authorize OUZZO S.A.S. to consult credit bureaus and databases for verification purposes.

  • Prevent unauthorized third parties from using the Platform.

  • Refrain from accessing restricted areas of the Platform.

  • Use the Platform lawfully and in good faith.

  • Avoid introducing viruses, malware, or harmful software.

  • Refrain from manipulating databases or systems without authorization.

  • Respect intellectual property rights associated with the Platform.

  • Refrain from impersonating another person or entity.

The User shall be liable for any damages suffered by OUZZO S.A.S. resulting from a breach of these Conditions.

Product Pricing

The price payable for Products shall be the price displayed on the Platform. Discounts, promotions, or special pricing shall only apply when expressly offered by OUZZO S.A.S.

The User shall pay the displayed price plus any applicable taxes, whether separately identified or not.

Limitation of Liability

Users access and use the Platform at their own risk. OUZZO S.A.S. shall not be liable for damages arising from improper use of Products after delivery.

OUZZO S.A.S. shall not be liable for interruptions or unavailability of the Platform resulting from:

  • Internet outages or network failures.

  • Computer viruses, malware, worms, or cyberattacks.

  • Unauthorized access by third parties.

  • Maintenance activities.

  • Force majeure events or circumstances beyond its reasonable control.

Nevertheless, OUZZO S.A.S. will make reasonable efforts to maintain Platform availability.

Payments

Payments are processed through Mercado Pago.

By completing a purchase, the User expressly authorizes OUZZO S.A.S. to issue and electronically deliver invoices or equivalent tax documents in accordance with Colombian law.

Upon successful completion of a transaction, the User will receive an email confirmation detailing:

  • Payment information.

  • Purchased Products.

  • Delivery details.

The User acknowledges and accepts electronic invoicing and is responsible for providing a valid email address for this purpose.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Colombia.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

Dispute Resolution

Any dispute relating to the formation, execution, termination, or liquidation of this agreement shall be resolved by a single arbitrator acting in law.

The arbitration shall take place in Medellín, Colombia, and shall be governed by the rules of the Arbitration and Conciliation Center of the Medellín Chamber of Commerce.

The losing party shall bear the costs of arbitration.

Intellectual Property

OUZZO S.A.S. owns all intellectual and industrial property rights relating to the Platform, including but not limited to:

  • Photographs

  • Images

  • Logos

  • Designs

  • Trademarks

  • Trade names

  • Source code

Any reproduction, modification, distribution, commercialization, public communication, or other use of the Platform or its contents without prior written authorization from OUZZO S.A.S. is strictly prohibited.

OUZZO S.A.S. reserves the right to pursue all available legal remedies, including criminal actions where applicable.

Confidentiality

The parties agree that all information exchanged under this agreement shall be treated as confidential, except where disclosure is required by law or competent authorities.

Notices

All communications between the parties shall be made electronically.

The User's contact email shall be the one provided during registration.

Any notice shall be deemed delivered on the date it is sent by email.

Returns and Exchanges Policy

Products purchased through the Platform are sold directly by OUZZO S.A.S.

To request a return, exchange, or complaint regarding a Product, the User must:

  1. Verify that the desired replacement size or color is available.

  2. Submit a return or exchange request.

  3. Send the Product to:

The Product must be returned:

  • With all tags and labels attached.

  • Clean and unused.

  • In its original packaging.

  • In perfect condition.

If the Product does not meet these requirements, OUZZO S.A.S. will notify the User by email and return the Product to the original shipping address.

Return-related costs, including shipping charges in both directions, are non-refundable unless a specific promotion expressly provides otherwise.
